Terms of Service
These Terms of Service (“Terms”) govern your use of PhoneLess (the “Service”), operated by [Company legal name] (“we” or “us”). By creating a card or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. The Service, and what it is not
PhoneLess stores a limited set of emergency contact information you choose to provide and displays it when your phone number and PIN are entered. The Service is a secondary informational tool only. It is not an emergency, dispatch, monitoring, medical, or rescue service. It does not contact emergency services for you and must not be relied on in place of emergency services, medical care, or professional advice. In an emergency, contact your local emergency number first.
2. Eligibility
You must be at least 18 years old, or the age of majority where you live, to create a card. You may not create a card for anyone other than yourself, and you may not create a card for a minor.
3. Your account and security
You must verify that you control the phone number used for your card. Your PIN lets anyone who knows it view your card, so you are responsible for choosing a PIN that is hard to guess and keeping it private. Changes to your card are made by signing in with a 6-digit code sent to your recovery email, so you are responsible for keeping that email account secure. Tell us promptly at [support@phonelesscard.com] if you believe your card or email has been accessed without permission.
4. Your content and acceptable use
You are responsible for the information on your card and confirm you have the right to share any contact details you add for other people. You agree to keep your card low-sensitivity and not to store home addresses, financial data, passwords, government ID numbers, or detailed health records. You agree not to attempt to access cards that aren’t yours, register a phone number you don’t control, deliberately trigger lockouts on another person’s card, or use the Service to harass, locate, or harm anyone. We may suspend or delete cards that violate these Terms.
5. Card+ membership, billing, and auto-renewal
When offered, Card+ is an optional paid membership billed $12 per year, or the price shown at purchase. It renews automatically each year using your payment method until you cancel. We will notify you before each renewal. You may cancel anytime in your settings. Cancelling stops future renewals, and you keep Card+ through the period you already paid for. Except where required by law, payments are non-refundable. Payments are processed by Stripe, and we do not store full card numbers. Physical backup cards ship to the address you provide, and delivery times are estimates. [Counsel to confirm auto-renewal disclosures for each state and country where Card+ is sold.]
6. Availability and disclaimers
The Service is provided “as is” and “as available,” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be available, uninterrupted, secure, or error-free at any time, including during an emergency, or that your contacts will be reachable. Internet, device, and third-party services outside our control may prevent access. Your card may also be temporarily locked, including by someone else entering wrong PINs.
7. Limitation of liability
To the maximum extent permitted by law, we and our suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss arising from your inability to access the Service or reach a contact, even if advised of the possibility. Our total liability for any claim relating to the Service will not exceed the amount you paid us in the 12 months before the claim, or [USD amount] if you paid nothing. Some jurisdictions do not allow certain limitations, so some of these may not apply to you.
8. Indemnification
You agree to indemnify and hold us harmless from claims arising from your content, your use of the Service, or your breach of these Terms.
9. Changes, termination, and governing law
We may update the Service or these Terms. We will tell you about material changes, and continuing to use the Service means you accept them. You may delete your card at any time. These Terms are governed by the laws of [State/Country], and disputes will be resolved in the courts of [venue], except where applicable law provides otherwise. [Arbitration or class-action waiver clause only on advice of counsel.]
10. Text messages (SMS Terms)
You agree to receive text messages from PhoneLess by ticking a separate checkbox during setup, which is unchecked by default. PhoneLess sends text messages only to a mobile number you have entered and verified as your own. These messages are limited to a verification code at setup and alerts about your own card: when it is opened, when someone enters a wrong PIN, and when it locks. PhoneLess does not send marketing or promotional texts, and we do not sell or share your SMS opt-in data or personal information with third parties for marketing purposes.
Message frequency varies and depends on activity on your card. Message and data rates may apply. Reply STOP to any PhoneLess text to stop receiving texts, or HELP for help. Stopping texts does not close your account: email alerts continue, and your dashboard shows that text alerts are off. Reply START to resume texts. Carriers are not liable for delayed or undelivered messages. For help, email support@phonelesscard.com.
